The Employer Cannot Be Reached to Schedule the Audit

No matter how often you call, you can’t ever reach the employer.  Either the phone rings and is never answered, the voice mail message comes on but the call is never returned, or the message you leave with the receptionist is never answered.

Every call or attempt to contact the employer should be logged.  You should have a policy that when 2 or 3 phone calls are not returned, you send a certified letter setting a tentative date for the audit and ask for an oral or written response.

In spite of all of these attempts, you may never be able to schedule the audit.  You then have no choice but to notify the plan’s collection attorney who can demand compliance with the plan document that compels the employer to agree to submit to a payroll audit.
